KEX LIMITED TERMS & CONDITIONS
Invoices are sent to your nominated email address,
Commercial accounts are invoiced weekly and full payment is due within 30 days of invoice date.
For large and private events, a deposit may be required and will be determined upon order being confirmed.
To avoid surprises, all our menu items are GST inclusive so the advertised price is what you will be invoiced.
We do our best to keep the website current, however we reserve the right to alter prices without notice.
Prices are fixed once your order has been confirmed, however if your requirements change and Kex Ltd agrees to the changes, a variation in price may occur.
All prices are in $NZD
Once your order request has been received by Kex Ltd, you will be sent a quote via email. Please ensure that all details are correct including: time and date of delivery and collection, number of people, dietary requirements, location and contact details. Once you are happy with the quote, please respond via email confirming the order. We cannot process your order until this email has been received.
4. BOOKINGS IN ADVANCE
For bookings in advance that require a deposit, Kex Ltdwill only confirm the order once the deposit has been received. It is at that point that the prices are confirmed. If, subsequent to the deposit being received, the quantities or order changes, Kex Ltd reserves the right to alter the pricing. Deposits are non-refundable.
5. HOURS OF TRADE
Our usual hours of trade are Monday to Friday 7:30am to 5:00pm.
Weekend and after hours orders are available, however are subject to a minimum spend. Please refer to ‘7. Minimum Spend’.
6. ORDERING CUT-OFF TIMES
Please ensure that all orders are in by midday the working day prior to your event to ensure we can accommodate your order.
If you require last minute or same day catering, please phone directly to Kex Ltd to check availability.
Last minute or same day catering may not have full access to the menu depending on availability, please phone Kex Ltd to check availability. Kex LtdN reserves the right to apply a surcharge on same day catering.
For after hours and large weekend orders, confirmation of the order must be made two working days before the event to ensure staffing requirements can be met.
7. MINIMUM SPEND
We do not accept orders for Sunday’s or public holidays, however if you have a special event, please enquire and we will assess on a case by case basis.
For all after hours and weekend orders, a minimum spend of $200 must be achieved for the order to be accepted.
8. DIETARY REQUIREMENTS
Kex Ltd can accommodate for most dietary requirements. Prior confirmation of dietary requirements is essential to ensure that they can be appropriately separated and labeled.
Please note if you have a guest that has severe allergies make this known to Kex Ltd. Whilst every effort is made to keep your order free from contaminants such as gluten, nuts, fish, eggs and soy all our food is made in a facility that contains these ingredients.
We are happy to discuss alternatives if a severe allergy is to be catered for.
Standard delivery hours are 7:30am to 5:00pm Monday to Friday. Kex Ltd reserves the right to apply a surcharge of 20% on deliveries outside of these hours.
Delivery fees apply to all individual orders. Delivery fee will be included in quote depending on location of delivery.
Kex Ltd will endeavour to deliver your order as close to your requested time as possible however in the instance where there are multiple deliveries for different customers, your order may arrive slightly earlier than planned.
10. PICK UP
Pick up can be arranged free of charge from Kex Ltd on 373 Maunganui Road, Mount Maunganui. Please confirm pick up upon confirmation of order.
11. CANCELLATION/POSTPONEMENT - COMMERCIAL
If your plans change and you need to cancel or postpone you order, please contact us directly via phone.
If you cancel your order within 72 hours of the event, Kex Ltd reserves the right to charge you up to 75% of the order to cover food costs.
If you postpone your order within 72 hours of the event, Kex Ltd reserves the right to alter the pricing of the original quote depending on availability. If subsequent booking is cancelled, Kex Ltd reserves the right to charge you up to 75% of the order to cover food costs.
12. CANCELLATION/POSTPONEMENT - PRIVATE/ONE OFF ORDERS
If your plans change and you need to cancel your order, please contact us via phone immediately. We do not offer postponement alternative dates for private/one off orders.
Once your deposit has been received, the following charges will be made for cancellation:
Cancellation within 14 days - no refund of deposit plus and additional charge of 25% of order to cover costs and lost sales.
Cancellation within 6 months of event - no refund of deposit
Cancellation between 6 and 12 months before event - 50% of deposit will be refunded.
Cancellation over 12 months before event - 75% of deposit refunded.
13. HEALTH AND SAFETY / FOOD HANDLING
Savoury items are delivered hot and ready to serve, unless requested to be delivered cold, or where you have requested multiple meal deliveries for the one delivery time. Food should be kept refrigerated until required.
Kex Ltd will not be held liable for the health and safety of our customers whereby food has not been chilled / reheated as per instructions, or consumed more than 30 minutes after the specified service time. Please refer to our ‘Guide to storing and reheating your catering’ as part of these terms and conditions.
Grazing tables and cheese platters are to be consumed within four hours of set up or delivery. Food must be disposed of after this time.
14. CATERING EQUIPMENT
Catering is delivered on Kex Ltd owned equipment that must be returned to Kex Ltd (pick up service available)
Any equipment that is damaged or not returned will be invoiced at the full replacement cost as follows:
Large round platters – $120, Medium round platters – $45, Ceramic bowls & platters– $40, Wooden boards – $50, Serving cutlery – Large spoons, Tongs – $20 each, Small dishes – From $10, Prices exclusive of GST
15. STAFF HIRE
If you would like your function to be serviced, we have experienced staff available. Staff rates are charged on a minimum of three hours, plus travel time to and from the venue. A Kex Ltd representative needs to attend all functions and events offsite. Any additional hours worked by the staff at your event as a result of changes to the planned run of events, or by circumstances out of our control will be charged to the client post event. 16. LATE PAYMENT
All accounts are payable within 30 days of the invoice date. We reserve the right to charge interest at 2.5% per month and to charge a late payment penalty of 10% on any overdue accounts. If the account is not paid within 30 days after the due date, our debt recovery agency may charge you a fee equal of 25% of the unpaid portion of the price, but not less than $25.00. Where the total agency, legal and other costs arising from recovery of any amount owing exceeds the debt recovery fee charged, our agent is also entitled to recover such additional costs from you. This clause is intended to be for the benefit of and be enforceable by our debt recovery agency under the contracts (Privacy) Act 1982.
I/We agree to indemnity you against all costs, whether commission, legal fee or otherwise, incurred by you or your duly authorised agents relating to any moneys, goods and services that may be outstanding from time to time pursuant to the terms of this agreement.
I/We agree that the terms of trade are strictly settlement on or before the 20th of the month following the month of delivery and that Kex Ltd will be entitled to charge interest at the rate of 5 % per month on all amounts that have not been paid in full by the 20th of the month following the month of delivery.
Kex Ltd is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.
Kex Ltd may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.
We may collect the following information: name and job title, contact information including email address and phone number, demographic information such as postcode, preferences and interests and other information relevant to customer surveys and/or offers.
We require this information to understand your needs and provide you with a better service, and in particular for the following reasons: internal record keeping to improve our products and services. To periodically send promotional emails about new menus, special offers or other information which we think you may find interesting using the email address which you have provided.
We will not provide your information to any third party partners for marketing or promotional purposes.
We will never sell your information.
